Athena Cosmetics, Maker of RevitaLash®, Files Suit Against Allergan for Alleged Violations of Federal Antitrust, Federal Trademark, and Federal Unfair Competition Laws
Henderson, Nevada (August 18, 2009) – Athena Cosmetics, Inc. today announced that on July 13, 2009, it filed a Second Amended Answer and Counterclaims against Allergan, Inc., alleging violations of federal antitrust law, federal trademark law, and federal unfair competition law. The allegations are based in part on Allergan’s conduct prior to and during its litigation of two pending patent infringement lawsuits. Now consolidated into one action, these lawsuits are pending against various manufacturers of eyelash enhancement products. Athena Cosmetics is the maker of RevitaLash® Eyelash Conditioner, a cosmetic product developed to enhance the appearance and beauty of natural eyelashes.
